Fundamental information

The group rides and events are a training ride and not a race. For this ride, each participant must bring their own bike suitable for the sport (e.g. racing bike), as well as their own clothing and equipment (helmets, shoes, rainwear if necessary, etc.). All natural persons who have reached the age of 18 (the organiser may request proof of age) and are physically able to take part in cycling are eligible to participate. doitnau.cc is an event broker and/or organiser.

By using doitnau.cc and registering for a ride/event of the organiser published on doitnau.cc, you as a participant declare your agreement to the following terms of use.

By participating in the Groupride, you also expressly confirm:

• that there are no health restrictions for participation (each participant is responsible for assessing their own health requirements for participation - the organiser assumes no liability for health risks of participants in connection with participation in the event);

• that you will observe and comply with the road traffic regulations (including locally applicable laws) during the ride;

• that you recognise the leadership and authority of any DOitNAU guide provided and follow their instructions;

• that you use a roadworthy bicycle and wear a proper, standardised (CE) helmet;

• that you consent to photos and videos being taken of you during the event;

• that you agree to the free publication of photos and videos of you as part of the event (e.g. social media). By participating in the Groupride or event, you automatically give your consent to the free publication for the aforementioned purposes without the need for your express consent;

• that doitnau.cc or third parties (e.g. cooperation partners) may contact you by e-mail at the e-mail address you have provided for up to 30 days after the event;

• that you participate voluntarily and at your own risk and responsibility;

• that you cannot appeal against an exclusion from the group ride or events, as well as further group rides or events due to unsportsmanlike or dangerous driving behaviour or take legal action against the exclusion;

• that neither the organiser nor DOitNAU is liable for any damages arising in connection with the event - except for damages caused by intentional or grossly negligent breach of duty. The risks include, but are not limited to: collisions with pedestrians, vehicles, other riders, movable or immovable objects; dangers arising from the nature of the route, from the failure of equipment, from the weather, from inadequate safety accessories, from accessories or material, etc.

• that risks may arise from participation in the group ride or events and your own actions, as well as from the actions or inactions of other participants in the event, from the nature of the area and the road conditions in which events take place, from the weather and the conditions under which the event takes place, as well as from the behaviour of the participant himself or other persons not involved in the event.

Liability and insurance

1. as a participant, you are fully responsible for your own actions and are personally liable in accordance with the statutory provisions. You are obliged to comply with all legally applicable rules, in particular the requirement to show consideration for other road users.

2. the organiser is not liable for damage caused by participation in the Groupride or an event for the typical dangers of cycling consciously assumed by the participant, in particular not for those caused by the participant's own actions. The organiser is also not liable for the actions of third parties that cause damage to participants.

3. liability for damage to property is limited to cases of intent or gross negligence. Liability for simple negligence is excluded. This does not apply to damages resulting from injury to life, body or health, which are based on a negligent breach of duty by the organiser or an intentional or negligent breach of duty by a legal representative or vicarious agent of the organiser. In the case of other damages, this does not apply to those based on a grossly negligent breach of duty by the organiser or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the organiser.

4. as a participant, you are responsible for your own insurance cover during your participation in the event. If fees are charged by the organiser for events, these do not include any insurance cover in the event of accident, illness or other insurance circumstances.

5. as a participant, you are aware that in the event of an accident for which the organiser is not liable under these terms and conditions, you must pay for any damage and any fees and costs incurred. This includes, but is not limited to, the costs of police, fire or emergency services, or comparable services such as mountain or height rescue. Should a situation arise in which participants are not in a position to make the decision to alert an emergency service or fail to do so, even though it would appear necessary from the perspective of an objective third party, they hereby give their consent for this to be done for the participant by an agent of the organiser or another person appointed by the organiser at the participant's expense. The participant cannot demand compensation from the organiser for any costs incurred for this.

6. As a participant, you are hereby informed that instructions during the exit and route during the event may deviate from the originally communicated and advertised instructions and briefings of the respective organiser due to important changes in traffic routing or other unforeseeable events.

7. all participants must have liability insurance, either through an association or through their own private insurance.

8. participants are recommended to take out suitable insurance to cover possible costs for emergency services during leisure activities. This includes, in particular, rescue, recovery and emergency medical services, the costs of which must otherwise be borne by the participants themselves.

Navigation with GPX route

1. navigation is carried out independently on the basis of the GPX track provided. This is to be understood as a suggestion and can or must be abandoned if, for example, (short-term) obstacles arise, planning errors occur or the legal situation (e.g. short-term road closures etc.) does not allow it to be followed.

2. appropriate hardware and knowledge of how to use it is assumed.

3. the organiser accepts no responsibility for damage or accidents caused by route deviations or obstacles on the route.

Right of cancellation

There is no right of cancellation for all events for which a participation fee is charged, as these are leisure events with a fixed date or period (Section 312g (2) No. 9 BGB).
